Investing In Tax Liens - Overview

The tax portion of the term typically refers to unpaid property taxes. The dictionary definition of lien is:

"The legal claim of one person upon the property of another person to secure the payment of a debt or the satisfaction of an obligation."

Tax lien is like a form of security wherein the individual's property is used as collateral to make sure that tax-related debt to another person is settled. Initially, the person with the property owes a debt to the government who imposed the taxes. However, after a certain period of time, the government agency will then take the property into auction to be able to compensate their expenses and open a new opportunity for savvy investors.

Tax liens are a result of the federal government and are not only 100% statutory, yet the concerns of the investors are protected by each state that they buy it from. To their benefit, State governments will then be the one responsible for the entire tax lien process.

Tax lien certificates are usually sold at tax sales organized by a county or municipal official. It is ultimately open and safe due to the fact that tax lien investors actually pay the officials the required taxes.

If everything else has been settled, the lien will then be handed to the investor from the government. To be fair, the property owner is given a time frame wherein he/she should pay a stated amount of the tax, interest and other related fees. But if the owner fails to pay on the given time, the investor will now have the right to foreclose the property because of the lien.

Investing in tax liens is a highly profitable investment. This is because you do not need to have a very big sum of money to be able to invest and it does not also require you to pay for any brokerage fees. Thus, tax lien certificates are very attractive to many.

Tax lien certificate is an investment that requires your attention and time. If it happens that you have made good purchases and have research the properties that are attached to the tax liens, then you would most likely be happier to acquire a property through foreclosure. However, the list of properties that you will usually have before the sale from the tax office is minimal only, in which it would only tell less about the property. Most often than not, you'll only acquire the tax ID, amount owed and owner of record.

The first thing that you have to do is look up the assessment information on the property and find the address. Physically looking at the property is best so youll be sure that the assessment information is up to date. Make sure that the property is worth considerably more than the amount thats owed for back taxes. Keep in mind that you may have to pay the taxes on this property throughout the redemption period (if it doesnt redeem) before you can foreclose on it or apply for a deed.

We need to examine the trend. Get the 10 day MA, the 20 day MA, and the 50 day MA. The formula is: 10 day MA greater than 20 day MA greater than 50 day MA. In this step we must look at the stock's 3 day high. If it is at a 3 day high, you can keep reading the next step below. If not, you need to ditch the stock and start over again with another stock.

The next step is to determine of the last price of the stock was above its 20 day MA. If it is, move on.

The next component in this formula is if the stock has hit a 3 week high in the last week (the previous full week of trading). If not, reject the stock and start over.

If Investments Are Hurting Your Credit, It's Time To Cut Your Losses

When it comes to investment properties, they have to be treated much like any other property that you have purchased, including the home that you're living in. In other words, if they go into foreclosure it's going to go on your credit, just like any other property would. With that in mind, you have to keep your investment properties up to date or liquidate them so that you don't damage your credit, and in this market it can be very hard to determine whether you can get a property rented or sold before you get behind on your payments, making the investment property issue a balancing act.

When the housing market was doing so well, investment properties were a huge business and everyone wanted a piece of it. They were rented out for the income, and they were flipped and resold by people who could do the work themselves and save money. Some houses even had waiting lists and/or went to the highest bidder because they were so very popular.

Now there are properties all over the place that no one seems to want and the people who have them as investment properties can hardly give them away. In Detroit and some of the other hardest-hit cities there are properties that aren't going for tens of thousands or even for thousands of dollars, but that are going for only a few hundred dollars, instead. People who were lucky and bought and sold when the market was good made a lot of money, but there were people who got stuck with a lot of properties and it left them wondering: what were they supposed to do next?

If you're stuck in the situation where you've got investment properties and you don't know what you're going to do with them, you are definitely not the only one and you'll find that there are a lot of people with whom you can talk and commiserate about what happened to the market at exactly the wrong time for you. You might also find that things aren't improving for you just yet and that you're starting to get behind on the payments that you're making to the mortgage company for the investment property that you can't sell, can't rent, and can't seem to do anything with. If you're facing this kind of problem your options are limited mostly to hanging on (if you can) until the market improves and trying to get out of the property in any legal way possible before it completely ruins your credit rating.

Even if there's already been some damage to your credit, the less damage there is and the shorter the period of time where late payments and other issues show up the less costly it will be to you in the long run when your credit is checked by a company that you're trying to use to finance something. The main thing is to avoid the damage, but if you're not able to do that the next best thing is to cut your losses and do some damage control in the form of getting rid of your investment properties before they can harm your credit and/or your financial future any more than they already have. To do that you have to know what's owed on them, what they're worth, and how you can most easily and quickly get rid of them - either by a deed to the bank in lieu of foreclosure, a short sale, or some other method.

Talking with your bank or lender and being honest about your financial difficulties is one of the best and smartest things that you could ever do when it comes to an investment property that otherwise might be facing foreclosure. Ideally, you should talk to your lender before you really get behind, but a lot of people wait much longer than that because they think that things will turn around and they're embarrassed to admit that they're having a problem. Don't let embarrassment or discomfort ruin your financial future and your good credit rating - talk to your lender right away as soon as you see that there might be a problem.

If you're up front about things, a lender that's handling your investment properties will be more likely to work with you and try to help you renegotiate your way to a better rate, a longer term, or something that can help you continue your investment. If it becomes clear that you won't be able to keep the property, though, talk to your bank about the options you have. You really want to keep a foreclosure off of your credit if at all possible, so check out the possible options that you have and pick the one that's the least damaging to your credit rating. - 23218
